Where There's a Will

The people behind an annual national initiative that uses legal knowledge about Wills to raise money for charities, have thanked Fidler & Pepper Lawyers for their fundraising.

Will Aid raises money for nine charities, including Christian Aid, Age UK, British Red Cross, the NSPCC and Save the Children. Since launching in 1988, Will Aid has worked with lawyers and solicitors to raise more than £20 million for good causes.

During the 2018 Will Aid scheme in November, Fidler & Pepper’s office in Mansfield and Sutton in Ashfield raised a total of £3,235.00 by taking donations rather than fees for writing a number of Wills.

Peter de Vena Franks, campaign director for Will Aid, said:

“I would like to offer my heartfelt thanks to Fidler & Pepper for their incredible efforts in 2018. Thanks to the commitment of local solicitors and lawyers that took part in Will Aid 2018, many people both in the UK and abroad will receive life-changing support, and local people who used the scheme have gained peace of mind thanks to having a professionally drawn up Will.”

It’s great to be involved in such an initiative and I believe we have over the years raised almost £30,000 just for Will Aid. This is something we are extremely proud of.”

Drop in Clinic, Powers of Attorney, Wills, Wills and Power of Attorney Checking Service    No Comments

We’re pleased to be launching a new initiative aimed at giving people peace of mind should they stop being able to make decisions for themselves. We’re offering to arrange Lasting Powers of Attorney for just £199.00 (Plus VAT) per person, per POA, throughout the month of March 2019.

There are two types of Lasting Powers of Attorney, covering Financial Decisions, or Health and Care. Having these in place means important and personal decisions are made by trusted people who you have chosen to do so.

Without such schemes in place, court or council-appointed organisations can make decisions on behalf of people who cannot make their own, perhaps due to injuries from an accident, or mental health matters.

Our Richard Howard, Fidler & Pepper’s Head of Private Client, said: “It can be too late to get a Power of Attorney in place, but it can never be too soon. Having a POA in place can reduce further heartache and give people peace of mind that wishes will be taken by family or friends.

“Sadly, for some people, life-changing events such as illnesses or accidents happen and they become incapacitated and unable to express their wishes and make decisions on their own.

“And it can mean that decisions are made that are not what family members or the person concerned might want. It can cause additional heartache, legal procedures and money when it really isn’t welcomed – or needed.”

Care Fees, Drop in Clinic, Making a Will, Powers of Attorney, Trusts, Wills, Wills and Power of Attorney Checking Service    No Comments

The success of our FREE legal drop-in clinics has prompted us to add more sessions to our January calendar of events!

Early last year we began fortnightly sessions at Sutton Library, part of the Idlewells Shopping Centre.

On alternate Friday mornings, members of the public can just go in to to see our experts and receive free advice on matters such as Wills, Power of Attorney, trusts and care fees.

Since launching this initiative, legal expertise has been shared with more than 50 people, for free.

Richard Howard, who heads the Private Client department, said: “While some of the matters are where we can offer simple guidance, we have also helped people to clarify, and sometimes correct, advice that they have received elsewhere.

The sessions are proving to be very popular, and so, in January, we are adding more to the calendar, with a particular emphasis on probate matters. This is a particular area that can been seen as confusing so it is vital people get the right advice.”

On January 4 and 11, people can speak to our specialist probate experts on a free, no appointment discussion.

On January 18 and 25, more general legal advice from Wills, Powers of Attorney, probate and trusts experts will be available.

Both sessions run between 9.30am and 12.30pm, and take place within the library, at Idlewells Precinct, Nottinghamshire, NG17 1BP.

Drop in Clinic, Making a Will, Wills, Wills and Power of Attorney Checking Service, Wills for £99    No Comments

One of the most important things you can do is to create a Will, but not many people get around to doing it. Maybe now is the time?

Our discounted service is being offered to encourage everyone to get their Wills written by the professionals.

During the whole of July our price for a single Will is £99 and a pair of Wills is £139 (Plus VAT). To compare, our usual prices are £115 for a single Will and £160 for a pair of Wills (Plus VAT)

We know that some people choose to get their Wills in place by downloading “do it yourself” kits off the internet. We would always advise that you get these checked by professionals to make sure they are legally correct.

Our Richard Howard – Head of Wills, trusts and probate matters, has seen a number of cases where people have made their own Wills that do not adhere to the current rules and regulations.

We know people go to the internet to find advice, and we know that some people just want to download documents and fill them in themselves.

But Richard has seen many problems arise from people who have used ‘do it yourself’ Wills kits as they are not aware of the rules that could affect what happens to their estate. In the case of Powers of Attorney too, for example, there might be rules about who can make decisions and who cannot.

Richard has seen mistakes happen and it could take a long time, expense, and worry, to rectify these errors. When we’re talking about Wills and Powers of Attorney, the emotions can run very high too. It’s best to get things right, and checked, before problems occur.

Richard has set up a checking service, similar to passport checking services, where people can email or bring in their prepared documents and get them looked over by experts.

We’ve noticed that more people are planning ahead and putting their Wills and Powers of Attorney in place. This is music to our ears as those people will get their final wishes granted. Whilst we’re pleased that more people are getting their affairs in order, we’re also increasingly aware that more people are drafting their own documents. This sometimes works out perfectly, but there are many other people coming to us during difficult and emotional times as their documents are incorrect. This has led to a lot of upset, delays and frustration and this also happens in what the client believed was a simple Will or Power of Attorney document.

What are Powers of Attorney?
Powers of Attorney are a legal way of asking named people to manage your affairs if you’re unable to. This could be because of a physical or mental illness, a disability, an accident or old age. In these situations the people that you choose to help you will be able to make decisions and arrangements on your behalf.

Do you know that there are different types…
There are different types of help that you might need, so there are different Powers of Attorney that you can put in place.

  • General Power of Attorney – Which can be used for a set period of time whilst you have mental capacity (for example if you’re out of the country).
  • Lasting Powers of Attorney can be used whilst you have mental capacity and if you lose mental capacity and there are 2 types:
  • ‘Financial’ which gives those named the responsibility to manage your financial affairs and your home.
  • ‘Health and Care’ gives others the authority to make decisions about your medical needs and treatment if you can’t

What most people don’t know about how long it may take
Most people don’t know that all Lasting Powers of Attorney need to be registered with the Office of Public Guardian which can take  2-3 months. Until this is registered, people can’t use the Power of Attorney. With this in mind it’s good to plan ahead and have the peace of mind these documents are in place early.

Guess what? Wills and Powers of Attorney are not just for the elderly
Some believe that thinking about these things is something you do when you retire, but it’s not the case! We find that people from all walks of life and ages contact us to make a Will or Power of Attorney. People with young families, those that travel frequently, those with a dangerous profession, with medical conditions and older people who want the peace of mind that everything is in place should they need it.

With the ease of the internet we know some people like to draft their documents themselves. That’s fine with us – but if you’d like us to give your Will or Power of Attorney a double check then we also have a ‘checking service’ where people can bring in prepared Powers Of Attorney and for a small fee we can take a look. It’s a lot like a passport checking service – you let us check it for you and we make sure it’s exactly as you want it. Sometimes there are rules you may not be aware of that could affect your estate or who can make decisions for you. We can let you know about those and if and how they affect you and your family.

No need to book for NEW Fidler & Pepper legal drop-in sessions in Sutton

As local experts in Wills, Trusts and Probate matters, we’re launching new, local drop-in clinics. The clinics will take place at Sutton Central Library on alternate Fridays starting on October 13, and will run between 9.30am and 12.30pm.

People who attend our clinics will be able to meet with Richard Howard, a Partner at our firm, or a member of his experienced team to discuss matters in confidence. The clinics will be free, but if further advice is needed, you will be able to make an appointment with Richard at a later date in the Fidler & Pepper offices in Low Street, Sutton.

Are you local and do you need legal help?

Many people think they don’t have time to sort out their Wills and some won’t know why Trusts and Probate matters are important. There are many local people worried about Care Fees and how this will affect them or their family. Some people might not like to go into the offices of a law firm and would feel more comfortable in an environment that they know. The drop-in clinics are a great way for people to come and talk to us about Wills, Trusts and Probate in a relaxed manner.
