Court of Protection


This one will be a bit of a moan, so please bear with me. I have spent almost half of my week dealing with the Court Funds Office (‘CFO’).  This is where your monies might be lodged if you lose your mental capacity and fall into the nightmarish realms of the Court of  Protection. For example, we manage the affairs of a particular lady who is in full time care in a nursing home.  She has money in the CFO, which is a bank account managed by the court.  To get at these monies, we must apply to the CFO with a variety of forms, and no one at the CFO seems to know which one they want!  We need money to pay her care bill, but after two months of pursuing these monies we are no closer, and the nursing home is losing patience. This could be avoided with a Lasting Power of Attorney (‘LPA’) (see my previous posts, or check our website for details).  No Court of Protection, no annual records to be filed, and, best of all, no CFO applications! I recommend to every client I meet that they draw up a LPA.  If you want to know more, please get in touch.
