Making a will – how hard can it be?


The other week I spent Friday evening watching the final episode of the BBC series “You Can’t Take it With You”. Yep, that’s how I spent my Friday night. Exciting. I haven’t seen other episodes in the series for a variety of reasons, watching England beat the Welsh in the Six Nations for one. But I thought I would have a look at how the BBC was assisting the national campaign to encourage people to make a Will. “Intestacy” (where a person dies without making a Will) is a common problem in our area, and apparently around 28 million people in the country do not have a Will. Some people just don’t want to think about dying, and some people honestly don’t realise what might happen if they haven’t made a Will. Family members can lose care allowances, or family members who aren’t getting along can suddenly be pushed together to make difficult decisions. Anyway…back to the program. Both of the families had slightly unusual situations. One had a disabled child who would need to be cared for when her parents died. Could they preserve her care benefits, whilst also looking after their other adult children fairly? The other retired couple had a tricky relationship with one of their children, but should they cut him completely out of their Wills? On the whole the program made Will writing look terrifying!! Arguing with relatives, not sure what to do, have you forgotten to look after your wife?!? Seeing a proper, human solicitor, should be easy: a bit of chat with the solicitor to start with, go away and think about a few ideas, let the solicitor know what you want, and they’ll put it into that awful 19th century language that solicitors still have to use.
